As a company the desire of DeerBrain is to collect the minimal amount of data as possible. If you refer to our Privacy policy for our NeverForget 9-11 app we collect absolutely nothing.

DEERBRAIN PRIVACY POLICY

This Privacy Policy applies to DeerBrain services (the “Service”), which include DeerBrain apps, websites, software, and related services, accessed via any platform or device, that link to this Privacy Policy. The Service is operated by DeerBrain LLC (“DeerBrain”, “we” or “us”).

We are committed to protecting and respecting your privacy. This Privacy Policy explains how we collect, use, share, and otherwise process the personal information of users and other individuals in connection with the Service.

By visiting, accessing, or using the Service, you expressly consent to the collection, use, storage, transfer, processing, and disclosure of your information, including Personal Information, as described in this Privacy Policy. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, DO NOT ACCESS OR USE ANY PART OF THE SERVICE, REGISTER FOR AN ACCOUNT, OR MAKE A PURCHASE. Beyond this Privacy Policy, your use of the Service is also subject to the Terms of Use located at https://deerbrain.com/terms-of-use (“Terms of Use”). All capitalized terms not defined in this Privacy Policy have the respective meanings set forth in the Terms of Use.

HIGHLIGHTS

Here are a few highlights:

- We collect Personal Information from you and from some third parties about you (such as when your payment is processed, if you log in from social media, etc.). You can see categories of Personal Information and if we collect and/or share them below.

- We do not sell your Personal Information and only share it with any third parties that are pivotal to providing the Service.

- Certain features within the Service allow DeerBrain to collect your geolocation. Collection of location information is limited to when you are using the Service.

- We use aggregated and anonymized data when possible, such as to test and improve the Service.

- The personal content you submit to the Service belongs to you, and you may choose to share it with other users through the Service. DeerBrain does not disclose individual account data with other users or third parties unless we’re legally compelled to do so.

INFORMATION WE COLLECT

We collect your information in three ways: information that you provide, automatically collected information, and information from other sources. More detail is provided below.

Personal Information You Provide to Us.

- Registration and Profile Information. When you sign up for an account, register to use the Service, enroll in a promotion or sign up for notifications, we will ask you for your email address and may request or receive other information such as your name, phone number, choice of state and billing address depending on the product or service you choose. If you sign up using a social media account, we will also receive information from those social media services such as your name, email address, city, state, zip code and third-party ID numbers. When interacting with the Service, you may also choose to provide other profile information, including photos and other identifying information.

- User content, including comments, photographs, livestreams, audio recordings, videos, and text that you choose to create, import, upload, or publish through our apps and websites. Even if you are not a user, information about you may appear in user content created or published by users on our apps and websites.

- Communications. If you contact us directly, we may receive additional information about you. For example, when you contact our support team, we may receive your name, email address, phone number, and the contents of a message or attachments that you may send to us, and other information you choose to provide.

- Payment Information. If you make a purchase through the Service, your payment-related information, such as credit card or other financial information, is collected by our third-party payment processor on our behalf.

- Certain features on the mobile device such as contacts, calendar, gallery, etc., but only where necessary for functionality you enable and with your permission.

Personal Information We Collect When You Use the Service.

- Location Information. When you use certain features of the Service, we receive your precise location information, including GPS coordinates in real time or through browser geolocation APIs (“GPS Location”). We may also collect the precise location of your device when a mobile application with location features is running in the foreground or background, depending on your settings and/or preferences. We use your location information to provide the Service. If the Service is unable to acquire your GPS Location, certain features of the Service may not be available to you. We also infer your general location information, for example by using your internet protocol (IP) address.

- Device Information. We may receive information about the device and software you use to access the Service, including IP address, web browser type, operating system version, phone carrier and manufacturer, application installations, device identifiers, mobile advertising identifiers, and push notification tokens, depending on the portions of the Service you access.

- Usage Information. To help us understand how you use the Service and to help us improve it, we automatically receive information about your interactions with the Service, like the pages or other content you view, the searches you conduct, purchases you make, and the dates and times of your visits.

- Information from Cookies and Similar Technologies. We and our third-party partners collect information using cookies, pixel tags, or similar technologies. Our third-party partners, such as analytics and advertising partners, may use these technologies to collect information about your online activities over time and across different services. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Service.

Information From Other Sources

We may receive the information described in this Privacy Policy from other sources, such as:

- We receive information about you from payment and transaction fulfillment providers, such as payment confirmation details, and information about the delivery of products you have purchased through the Service.

SENSITIVE PERSONAL INFORMATION

Information You Provide may include sensitive personal information, as defined under applicable state privacy laws. We process such information in accordance with applicable law, such as to provide the Service and other permitted purposes under state privacy laws, like the California Consumer Privacy Act ("CCPA"). You may choose whether or not you include sensitive personal information in your user content or in other information you voluntarily submit. The type of information that state privacy laws, such as the CCPA, have identified as sensitive personal information include the following: racial or ethnic origin, national origin, religious beliefs, mental or physical health diagnosis, sexual life or sexual orientation, status as transgender or nonbinary, citizenship or immigration status, or financial information. DeerBrain does not require you to provide this type of information. However, if you choose to publish user content about these topics, please keep in mind that such content may be visible to other users and the public, depending on your privacy settings.

HOW WE USE YOUR INFORMATION

We use the Information We Collect for the following purposes:

- To operate and administer the Service, such as enabling you to create, share, and consume content and to interact with other users and their content, and providing user support.

- To personalize and customize certain features and content.

- To promote our and third-party products and services through marketing campaigns, including communications, contests, and events. We may also use user content as part of our marketing campaigns, with your permission.

- To maintain and enhance the safety, security, and stability of the Service by identifying and addressing technical or security issues or problems (such as technical bugs and spam accounts), and detecting abuse, fraud, and illegal activity.

- To communicate with you, including to notify you about changes in our services.

- To enforce our Terms of Use and other conditions and policies that apply to you and to protect the safety of our community and integrity of the Service, including by scanning, analyzing, and reviewing user content and associated metadata.

- To comply with our legal obligations and defend our legal rights and commercial interests, and those of our affiliates, users, and the public.

- For any other purposes disclosed to you at the time we collect your information or pursuant to your consent.

- To combine Information We Collect for any of the foregoing purposes.

- To aggregate or de-identify Information We Collect.

Profiling: We do not engage in profiling which results in legal or similarly significant effects, as defined under applicable law.

HOW WE USE INFORMATION TO IMPROVE DEERBRAIN

We’re always trying to make DeerBrain better and create new products with the features you want. Information we collect from you helps us learn how.

For example, we use information we collect to:

- Develop and improve products and features

- Build and test out new products and features to see if they work

- Get feedback on our ideas for products or features

- Conduct surveys and other research on what we can do better for DeerBrain

To use less information that’s connected to individual users, in some cases we de-identify or aggregate information or anonymize it so that it no longer identifies you. We use this information in the same ways we use your information as described in this Policy.

We also use your information to review, support, improve, and develop the Service, and train, test, and improve technology, such as machine learning models and algorithms, including by analyzing how people are using the Service; conducting research; soliciting feedback; monitoring your activity and usage across the devices you use to access the Service; and scanning, analyzing, and reviewing user content and associated metadata.

We also use manual review to analyze content to train our algorithms to review content the same way a person would. This improves our automatic processing, which in turn helps us improve our products.

Our reviewers work at DeerBrain or for a trusted service provider. We require every reviewer who's allowed access to your information to meet privacy and security standards.

HOW WE SHARE YOUR INFORMATION

We don't sell any of your information to anyone, and we never will. We also require partners and other third parties to follow rules about how they can and cannot use and disclose the information we provide.

We keep aggregated information about our users, and information that does not identify any individual or device, inside DeerBrain.

We do not share your personal information with companies, organizations, or individuals outside of DeerBrain except in the following cases:

With your consent

We’ll share personal information outside of DeerBrain when we have your consent. We’ll ask for your explicit consent to share any sensitive personal information.

For external processing

We provide personal information to our affiliates and other trusted businesses or persons to process it for us, based on our instructions and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures. For example, we use service providers to help operate our data centers, deliver our products and services, improve our internal business processes, and offer additional support to customers and users.

For legal reasons

We will share personal information outside of DeerBrain if we have a good-faith belief that disclosure of the information is reasonably necessary to:

- Respond to any applicable law, regulation,legal process, or enforceable governmental request.

- Enforce applicable Terms of Use, including investigation of potential violations.

- Detect, prevent, or otherwise address fraud, security, or technical issues.

- Protect against harm to the rights, property or safety of DeerBrain, our users, or the public.

If DeerBrain is involved in a merger, acquisition, or sale of assets, we’ll continue to ensure the confidentiality of your personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.

YOUR RIGHTS AND CHOICES

You may submit a request to know, access, correct or delete the information we have collected from or about you by emailing us at inaDeerBrain@gmail.com or GetInside@DeerBrain.com. You may appeal any decision we have made about your request through these same methods. Through your in-app settings, you can delete your account. We will not retaliate against you for exercising your rights and choices, although some aspects of the Service may no longer be available to you.

You may be entitled, in accordance with applicable law, to submit a request through an authorized agent. To designate an authorized agent to exercise choices on your behalf, please provide evidence that you have given such agent power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf. We will respond to your request consistent with applicable law and subject to proper verification. We will verify your request by asking you to send it from the email address associated with your account or to provide information necessary to verify your account.

You can also control the information we collect and opt out of certain activities in the following ways:

- You may be able to control some of the Information We Collect by refusing or disabling cookies through your device browser settings. Because each browser is different, please consult the instructions provided by your browser. Please note that you may need to take additional steps to refuse or disable certain types of cookies. In addition, your choice to disable cookies is specific to the particular browser that you are using when you disable cookies, so you may need to separately disable cookies for each type of browser. Some browsers transmit “do-not-track” signals to websites. Because of differences in how browsers incorporate and activate this feature, we currently do not take action in response to these signals. Please be aware that if you choose to refuse, disable, or delete cookies, some of the functionality of the Service may no longer be available to you. Without this information, we are not able to provide you with all of the requested services.

- Location Information. You can prevent your device from sharing precise location information at any time through your device’s operating system settings. However, location is core to certain parts of the Service and without it, you may not be able to successfully use the Service.

- You can opt out of receiving marketing emails by using the “unsubscribe” link or mechanism noted in those emails.

HOW LONG WE KEEP YOUR INFORMATION

We retain the data we collect for different periods of time depending on what it is, how we use it, and how you configure your settings:

- Some data you can delete whenever you like, such as your personal info or the content you create or upload, like photos and documents. We’ll keep this data in your DeerBrain account until you remove it or choose to have it removed.

- We keep some data until you delete your DeerBrain account, such as information about how often you use our services.

- And some data we retain for longer periods of time when necessary for legitimate business or legal purposes, such as security, fraud and abuse prevention, or financial record-keeping.

When you delete data, we follow a deletion process to make sure that your data is safely and completely removed from our servers or retained only in anonymized form. We try to ensure that our services protect information from accidental or malicious deletion. Because of this, there may be delays between when you delete something and when copies are deleted from our active and backup systems.

DATA SECURITY

We use reasonable measures to help protect information from loss, theft, misuse, unauthorized access, disclosure, alteration, or destruction. You should understand that no data storage system or transmission of data over the Internet or any other public network can be guaranteed to be 100 percent secure. Please note that information collected by third parties may not have the same security protections as information you submit to us, and we are not responsible for protecting the security of such information.

DATA BREACH

In the event we become aware that the security of the Service has been compromised or users’ personal information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. In the event of a data breach, we will make reasonable efforts to notify affected individuals if we believe that there is a reasonable risk of harm to the user as a result of the breach or if notice is otherwise required by law. CHILDREN’S PRIVACY

We do not knowingly collect, maintain, or use Personal Information from children under 18 years of age, and no part of the Service is directed to children. U.S. STATE PRIVACY RIGHTS

- We explain when DeerBrain may disclose information in How We Share Your Information. DeerBrain does not sell your personal information. DeerBrain also does not “share” your personal information as that term is defined in the California Consumer Privacy Act (CCPA).

- We explain how DeerBrain retains information in How Long We Keep Your Information. When DeerBrain anonymizes data to protect your privacy, we maintain policies and technical measures to avoid re-identifying that information.

U.S. state privacy laws also provide the right to request information about how DeerBrain collects, uses, and discloses your information. And they give you the right to access your information, sometimes in a portable format; correct your information; and to request that DeerBrain delete that information. Many of these laws also provide the right to opt out of certain forms of profiling and targeted advertising. They also provide the right to not be discriminated against for exercising these privacy rights. Additionally, the CCPA treats certain kinds of information, like health data, as sensitive; when users provide this information, DeerBrain only uses it for purposes permitted by the CCPA, like to provide services that are requested and expected by our users.

The Service is hosted in the United States and intended for visitors located within the United States. Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Service.
